Summary

The Act creates a national framework for the application of the Border Carbon Offset Mechanism (CBAM) under EU law and clearly sets out the rights and obligations of importers of selected goods. It establishes rules for the handling of CBAM certificates, control of declarations and determination of penalties, including penalties linked to EU rates and inflation. At the same time, it distributes competences between ministries and customs authorities, strengthens the exchange of information with the European Commission and is intended to reduce legal uncertainty for importers from 2026 and contribute to climate protection.

[1/1] Tato část dokumentu zavádí národní právní rámec pro uplatňování mechanismu uhlíkového vyrovnání na hranicích (CBAM) v návaznosti na přímo použitelné předpisy Evropské unie a vymezuje práva a povinnosti dovozců vybraného zboží. Zákon stanoví pravidla pro poskytování jistoty (složením peněžní částky nebo bankovní zárukou), prodej, vyřazování a zpětný odkup certifikátů CBAM a upravuje postupy při kontrole prohlášení a zpráv CBAM, včetně možnosti, aby ministerstvo samo určilo počet certifikátů k vyřazení. Dále detailně vymezuje skutkové podstaty přestupků pro oznamující deklaranty, schválené deklaranty i jiné osoby, včetně přesných pravidel výpočtu pokut navázaných na euróvé sazby a index spotřebitelských cen EU. Dokument jasně rozděluje kompetence mezi Ministerstvo životního prostředí, Generální ředitelství cel a celní úřady, přičemž výkon CBAM agendy celními orgány je (s výjimkou přestupků) považován za správu daní. Součástí úpravy je i intenzivní výměna informací s Evropskou komisí, vedení rejstříku CBAM, pravidla elektronického rozhodování a průlom do daňové mlčenlivosti pro účely vnitrostátní spolupráce. Důvodová zpráva zdůrazňuje, že zákon nepřekračuje rámec práva EU, má odstranit právní nejistotu dovozců od roku 2026 a přispět k ochraně klimatu omezením úniku uhlíku.
