The bill implements the EU directive and modernizes liability for damages caused by defective products, effective December 9, 2026. Protection for individuals is extended to software, digital production files, related digital services, and the loss or damage of non-professional data. In addition to the manufacturer, component manufacturers, importers, representatives, distributors, or certain online platforms may also be liable for damages, particularly if the manufacturer established in the EU cannot be traced. Claims are facilitated by presumptions of evidence; the ten-year statute of limitations is abolished and generally replaced by a ten-year period of extinction of rights, which extends to 25 years in cases of health damage that manifests later.
